they have sufficient oversight of artificial intelligence (AI) use in their businesses, a broker has said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Miller Insurance highlighted the emerging issue in\u00a0a review of the London construction market.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While there has been much talk of AI technology improving efficiency and accuracy in the building sector, it said concern has grown among insurers about risks relating to areas including governance and data security.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cProposals now often include questions about AI, reflecting concerns over intellectual property issues, design errors and potential negligence from inadequate oversight,\u201d the broker said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to Miller, insurers are particularly keen to look at how construction firms use generative AI in design, planning and risk forecasting.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">AI use has soared in popularity in recent years as the technology has improved, including in construction. <\/span><a href=\"https:\/\/www.constructionnews.co.uk\/tech\/balfour-beatty-unveils-7-2m-ai-investment-with-microsoft-31-07-2025\/\"><span style=\"font-weight: 400;\">Last month<\/span><\/a><span style=\"font-weight: 400;\">, Balfour Beatty announced a \u00a37.2m investment in Microsoft&#8217;s 365 Copilot AI tool, which runs alongside applications such as Outlook and Excel, as part of a digital transformation strategy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The contractor said it aimed to boost productivity and site safety through automation and better decision-making.<\/span><\/p>\n<p><a href=\"https:\/\/www.constructionnews.co.uk\/tech\/treat-ai-as-your-colleague-says-ciob-report-25-06-2024\/\"><span style=\"font-weight: 400;\">Guidance issued by the Chartered Institute of Building (CIOB) last year<\/span><\/a><span style=\"font-weight: 400;\"> urges construction workers to treat AI as a \u201cnew colleague\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The document says AI offers the opportunity to improve everyday working patterns, and CIOB encourages staff to \u201cTreat AI as your new colleague, your construction assistant, potentially removing the burden from often repetitive data tasks.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It advises: \u201cWork out where it can provide complementary analytical skills, pattern recognition, consistency and increased processing speed.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the<\/span><a href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/artificial-intelligence\/guidance-on-ai-and-data-protection\/how-should-we-assess-security-and-data-minimisation-in-ai\/\"> <span style=\"font-weight: 400;\">Information Commissioner\u2019s Office<\/span><\/a><span style=\"font-weight: 400;\">, which regulates around data laws, AI systems have the potential to \u201cexacerbate known security risks and make them more difficult to manage\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Companies have duties to process personal data in a way that ensures it is not unauthorised or unlawfully processed, and this can be made harder when using AI systems.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In January, the Department for Science, Innovation and Technology published<\/span><a href=\"https:\/\/www.gov.uk\/government\/publications\/ai-cyber-security-code-of-practice\"> <span style=\"font-weight: 400;\">advice<\/span><\/a><span style=\"font-weight: 400;\"> to guard AI systems against cybersecurity threats.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Elsewhere in Miller\u2019s half-year overview, it said \u201crobust\u201d capacity and \u201cgood\u201d appetite among PI insurers to provide cover was fuelling competition and driving premiums down.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A half-year report by Gallagher, another broker, released last month, also said heightened competition was pushing down rates.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Miller warned that issues remain for smaller companies, however.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWith improving market conditions, there has been a clear trend towards higher contractual requirements for PI limits, especially from public sector bodies and tier-one contractors,\u201d it said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis is putting pressure on some consultancies and specialist subcontractors to significantly increase their cover to stay eligible for tender opportunities.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It said that businesses that demonstrated strong internal governance, robust quality-control processes and clear supply chain diligence would get better deals.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Earlier this year,<\/span><a href=\"https:\/\/www.constructionnews.co.uk\/sections\/long-reads\/features\/twin-peaks-will-new-safety-laws-spark-insurer-backlash-16-05-2025\/\"> <i><span style=\"font-weight: 400;\">Construction News <\/span><\/i><span style=\"font-weight: 400;\">explored whether changes introduced under the Building Safety Act 2022<\/span><\/a><span style=\"font-weight: 400;\"> could lead to the PI insurance market grinding to a halt, as it did in the aftermath of the 2017 Grenfell Tower fire.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Commenting on the impact of the act, Miller said: \u201cEarly disputes suggest that safety-compliance failures may constitute breaches of professional duty, possibly triggering PI claims.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThese cases will shape future interpretations of coverage, particularly regarding exclusions tied to known risks and regulatory
