Galliford Try has failed in a High Court attempt to extend the deadline for bringing claims over alleged defects at the Hive library and history centre in Worcester, more than a decade after the building opened.<\/p>\n
The case centres on long-running problems with water leaks at the Hive, built by Galliford Try under a private finance deal for WLHC ProjectCo.<\/p>\n
The building opened in 2012 as a joint project between Worcestershire County Council and the University of Worcester.<\/p>\n
Galliford Try issued legal proceedings in January 2024 against four firms: Arcadis, which handled engineering design; Briggs & Forrester, the mechanical and electrical subcontractor; Feilden Clegg Bradley Studios, the architect; and Northfield Construction, which built the concrete frame.<\/p>\n
The contractor had asked the court to extend a pause in proceedings to allow more time for a settlement meeting and to gather expert evidence.<\/p>\n
But last week, judge Mr Roger ter Haar ruled that Galliford Try had not done enough to protect its legal position and had missed the deadline to formally serve its claim on the defendants.<\/p>\n
A key meeting aimed at resolving the dispute had been pushed back from February to March 2025 to allow Galliford Try\u2019s expert to complete a report on the water ingress.<\/p>\n
While all parties agreed to delay the meeting, they disagreed over whether this also extended the court deadline.<\/p>\n
The judge said the extension had not been properly agreed and that Galliford Try should have either served the legal documents on time or applied earlier for more time.<\/p>\n
As a result, the firms Galliford Try is pursuing may now be able to argue that the claims are out of time.<\/p>\n
The Hive project included complex construction and design elements. Practical completion was certified in 2012, but Galliford Try says defects in the building have since caused problems, particularly in the basement archive.<\/p>\n","protected":false},"excerpt":{"rendered":"
