But any attempt to overhaul it is not risk-free. Recent history is littered with examples of well-intentioned ministers launching similar consultations before shying away from meaningful change.<\/p>\n<p><em>Construction News<\/em> has consistently highlighted the impact of late payment on smaller firms. Specialist businesses take on apprentices, invest in training, buy materials up front and deliver highly technical packages of work. Yet many effectively extend credit to clients and main contractors on interest-free terms. Once disputes arise, smaller companies face organisations with far greater commercial and legal muscle.<\/p>\n<p>The case for change is strong. A system that starves productive businesses of cash also undermines their resilience and growth. For subcontractors working on thin margins, every delayed payment hangs a sword of Damocles over their operations. Some are forced to pay their own subcontractors late. Others do not have that option. And the mental health toll can be substantial.<\/p>\n<p>But reform is not straightforward. Tier one contractors themselves work with unpredictable client payment cycles and often absorb the financial load of long-term public and private schemes. Retentions and extended terms \u2013 however unwelcome their downstream effects \u2013 sit at the heart of many large firms\u2019 working-capital strategies. Most major contractors are already operating with limited headroom. Like it or not, getting money to subcontractors more quickly will reduce the amount of working capital available to tier ones. There is no small danger that this could narrow their ability to tender and bear risk.<\/p>\n<p>Some voices for reform believe the benefits would outweigh such disadvantages. And it\u2019s certainly hard to imagine anyone would design a system in the way that the current one operates. But the short-term impact of enforcing shorter payment periods and ringfencing retentions cash could, in the short term at least, negatively impact the very supply chains that the reforms are designed to strengthen.<\/p>\n<p>Ministers therefore face a choice between two imperfect outcomes. One leaves smaller firms bearing disproportionate financial risk; the other risks destabilising the organisations responsible for delivering the bulk of the nation\u2019s infrastructure and housing. That is the bind ministers must now untangle.
