{"id":534261,"date":"2025-12-09T08:00:07","date_gmt":"2025-12-09T08:00:07","guid":{"rendered":"https:\/\/www.constructionnews.co.uk\/?p=534261"},"modified":"2025-12-09T09:26:07","modified_gmt":"2025-12-09T09:26:07","slug":"firm-fined-80000-after-worker-fell-through-skylight","status":"publish","type":"post","link":"https:\/\/www.constructionnews.co.uk\/health-and-safety\/firm-fined-80000-after-worker-fell-through-skylight-09-12-2025\/","title":{"rendered":"Skylight fall leads to \u00a380,000 fine for construction company"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">A construction company in Hampshire has been fined \u00a380,000 after a man fell more than 15ft through a skylight during roof repair work.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">J Smith Construction Services Ltd had been carrying out repairs to a roof at The Tanneries Industrial Estate in Titchfield when a 29-year-old subcontractor fell, according to the Health and Safety Executive (HSE).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The inspectorate said the worker suffered multiple fractures and was unable to work for months as a result of the incident, which happened over the weekend of 13-14 January 2024.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An HSE investigation found that the firm had failed to erect scaffolding at the edges of the roof.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIn an attempt to speed up the project, the company planned to work over the weekend of 13-14 January 2024 and took on extra workers to help, including the subcontractor,\u201d the health and safety watchdog said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe company did not arrange for scaffolding to be erected at the open edges of the roof, nor make adequate arrangements to prevent or mitigate falls through fragile areas of the roof.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cAs there was nothing to prevent or reduce his fall through the skylight, the man fell from the height of the roof to the solid floor below.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite the incident, the firm continued work on the roof the next day with no additional safety measures in place, the HSE said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the watchdog, J Smith Construction Services Ltd, of Southampton, pleaded guilty at Southampton Magistrates\u2019 Court on 4 December to breaching the Work at Height Regulations 2005, Regulation 6(3), and was fined \u00a380,000 and ordered to pay \u00a32,630 in costs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Company director Joseph Smith pleaded guilty to breaching the Health and Safety at Work etc Act 1974 s37(1). He was given a three-month prison sentence suspended for 12 months and ordered to pay \u00a32,630 in costs, the HSE said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A spokesperson for the inspectorate said: \u201cThese sentences should send a clear message to employers that HSE and the courts take a failure to comply with health and safety legislation extremely seriously.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cToo many workers are injured or killed every year as a result of falls from height during construction work.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThese incidents can be prevented if reasonably practicable measures such as scaffolding or netting are put in place to protect workers.\u201d<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A construction company in Hampshire has been fined \u00a380,000 after a man fell more than 15ft through a skylight during roof repair work.
