{"id":534777,"date":"2025-12-16T13:00:49","date_gmt":"2025-12-16T13:00:49","guid":{"rendered":"https:\/\/www.constructionnews.co.uk\/?p=534777"},"modified":"2025-12-16T13:00:49","modified_gmt":"2025-12-16T13:00:49","slug":"tier-ones-plead-not-guilty-in-hinkley-point-c-death-case","status":"publish","type":"post","link":"https:\/\/www.constructionnews.co.uk\/legal\/tier-ones-plead-not-guilty-in-hinkley-point-c-death-case-16-12-2025\/","title":{"rendered":"Tier ones plead not guilty in Hinkley Point C death case"},"content":{"rendered":"<p><span data-teams=\"true\">Two tier one contractors have entered not guilty pleas to health and safety offences in two separate cases relating to a death and a serious injury at Hinkley Point C.<\/span><\/p>\n<p>Both cases have been brought following investigations by the Office for Nuclear Regulation (ONR).<\/p>\n<p>The first case relates to the death of worker Jason Waring, 48, who died on 13 November 2022 after sustaining fatal injuries at the site.<\/p>\n<p>Laing O\u2019Rourke Delivery Ltd and Bouygues Travaux Publics SAS both entered not guilty pleas to a charge of failing to plan, manage and monitor that construction work was carried out without risks to health and safety, contravening Regulation 15(2) of the Construction (Design and Management) Regulations 2015, according to the ONR.<\/p>\n<p>Laing O\u2019Rourke and Bouygues Travaux Publics make up the Bylor joint venture, which is delivering the main civil engineering works at Hinkley Point C.<\/p>\n<p>A third firm, NNB Generation Company (HPC) Ltd (NNB GenCo), the principal contractor on the project, also denied charges of failing to plan, manage and monitor the construction phase and of coordinating matters relating to health and safety during the construction phase to ensure that work was carried out without risks to health and safety, contravening Regulation 13(1) of the Construction (Design and Management) Regulations 2015, the ONR said.<\/p>\n<p>The second case relates to an incident at Hinkley Point C on 20 August 2022, when employee Paul Dunne, who worked for Bylor as a slinger, sustained serious injuries in a pre-fabrication yard when a wall of rebar mesh fell on him as he was working to remove the wall from a vertical jig to be transferred to another part of the site, the ONR said.<\/p>\n<p>In this case, Laing O\u2019Rourke and Bouygues Travaux Publics also denied a separate charge of failing to plan, manage and monitor to ensure that construction work was carried out without risks to health and safety, contravening Regulation 15(2) of the Construction (Design and Management) Regulations 2015.<\/p>\n<p>All firms entered the pleas at Bristol Magistrates Court on Monday (15 December), the ONR said.<\/p>\n<p>The cases have now been sent for trial. A pre-trial review hearing for both cases has been set for 30 January 2026 at Bristol Crown Court.<\/p>\n<p>Commenting on the first case, a spokesperson for Hinkley Point C said: &#8220;Safety is our overriding priority and the project co-operated fully with the ONR investigation. Our thoughts primarily remain with the family, friends and colleagues of Jason. As legal proceedings are ongoing, it would not be appropriate to comment further at this time.\u201d<\/p>\n<p>A spokesperson for Bouygues Travaux Publics SAS said it had \u201ccooperated with the relevant official authorities in the context of the investigation\u201d, but said it does not comment on ongoing legal proceedings.<\/p>\n<p>Laing O\u2019Rourke pointed <i data-stringify-type=\"italic\">Construction News\u00a0<\/i>to the comment by Hinkley Point C.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Two tier one contractors have entered not guilty pleas to health and safety offences in two separate cases relating to a death and a serious injury at Hinkley Point C.
