A former Vinci employee who claimed two managers harassed her due to her sex after she reported paint damage and scratches to her car has lost her tribunal case.<\/p>\n

Site administrator Susan Turner made the allegations against construction manager David Smolinski and commercial manager Barry Powell over how they dealt with two complaints she raised about damage to her car.<\/p>\n

However, an employment tribunal in Manchester has thrown out her claims, which were filed in November 2023, in a judgment published last week.<\/p>\n

Judge Gary Tobin ruled Turner was \u201cnot harassed in relation to her sex\u201d and said she had acted \u201cunreasonably in pursuing her claims\u201d.<\/p>\n

Turner, who worked for Vinci<\/a> from 13 March 2023 to 31 October 2023, was ordered to pay Vinci \u00a34,200 in court costs.<\/p>\n

In his judgment, which followed a two-day trial in December 2024, Judge Tobin said the case arose after Turner\u2019s new Mini, along with 10 other employees\u2019 cars, was accidentally sprayed with paint by subcontractor JM Passive while parked at a site in Blackpool on 13 October 2023.<\/p>\n

It led to JM Passive\u2019s managing director John Maguire apologising to the car owners and offering to have their cars valeted by valet firm Dagger Dan, the judgment said. However, Turner was unhappy with the resolution.<\/p>\n

She raised the issue with Smolinski and Powell and liaised with JM Passive via email to address the problem between 16 October and 25 October 2023.<\/p>\n

On 23 October 2023, Smolinski said to Turner: \u201cI don\u2019t know why you don\u2019t let them try and clear your car,\u201d the judgment says.<\/p>\n

The claimant was annoyed by the comment, leading Smolinski to tell her that she should \u201cdo what you want then\u201d, the judge said.<\/p>\n

In her case to the tribunal, Turner alleged that Smolinski\u2019s comments amounted to him \u201cpressurising her\u201d into allowing Dagger Dan to use \u201cdangerous chemicals\u201d on her car.<\/p>\n

In his judgment, the judge said: \u201cThere was no overt pressure, threat or intimidation that there would be any consequence if the claimant did not agree with Mr Smolinski.<\/p>\n

\u201cThe facts as we find do not bear out that Mr Smolinski tried to pressurise the claimant into the Dagger Dan option. Perhaps he was fed up with the claimant\u2019s complaining. Mr Smolinski merely proffered a sensible suggestion.\u201d<\/p>\n

The judge added that Turner admitted in evidence that she did not know that \u201cdangerous chemicals\u201d would be used until the next day so \u201cthere could have been no reference\u201d to them in the conversation.<\/p>\n

On 24 October 2023 she instead parked her car in a nearby supermarket where she claims it was scratched and had been \u201ckeyed\u201d.<\/p>\n

She reported this to Powell, alleging that someone from JM Passive was responsible due to her not accepting their valet offer, the tribunal heard.<\/p>\n

Turner also told Powell that JM Passive was \u201charassing her\u201d by sending her emails. She claimed Powell responded by saying \u201cwhat do you want me to do about it\u201d.<\/p>\n

However, the judge found the comment he made was in relation to the scratches found on her car and Powell had already told JM Passive he was seeking to resolve the matter through Vinci\u2019s insurers.<\/p>\n

\u201cWe determine that Mr Powell was, in fact, supportive in this meeting as he offered to go with the claimant to look for CCTV footage,\u201d Judge Tobin said.<\/p>\n

\u201cIt is not feasible that someone from JM Passive would hunt down the claimant\u2019s car in a local supermarket car park to damage it because the claimant would not accept her trying out Dagger Dan\u2019s valet service.\u201d<\/p>\n

In dismissing the harassment allegation, the judge said it was \u201cdifficult to understand\u201d how Powell\u2019s comment could have had the effect of \u201ccreating an intimidating, hostile, degrading, humiliating or offensive environment for her\u201d.<\/p>\n

\u201cThe test is not whether the comments could be perceived as negative or critical, but whether a reasonable person would consider they had that effect when taking into consideration the broader context and circumstances of the discussions,\u201d he said.<\/p>\n

The tribunal also threw out her claims of sexual discrimination.<\/p>\n

The judge said that Turner was unable to explain how the alleged comments related to her sex and her assertion that she was the only woman affected was not correct as another female employee\u2019s car had also suffered damage.<\/p>\n

\u201cThere is no link or implication that any discussion that did take place on either occasion was related to the claimant\u2019s sex,\u201d he added.<\/p>\n

He said there is no prime facie evidence of a link between the managers\u2019 comments and her sex and her claims had \u201cno merit\u201d.<\/p>\n
