claims it is immune from defective cladding legislation"},"content":{"rendered":"<p>Grenfell Tower material producer Arconic has claimed it is immune from liability in a \u00a32.73m High Court legal action over cladding used on three other London high-rises \u2013 because it is based in France.<\/p>\n<p>In September, <a href=\"https:\/\/www.constructionnews.co.uk\/buildings\/building-safety\/equans-cites-grenfell-evidence-in-2-73m-cladding-claim-against-arconic-21-11-2025\/\">Equans launched a \u00a32.73m High Court claim<\/a> against Arconic Architectural Products SAS alleging that it knowingly supplied \u201cextremely dangerous\u201d Reynobond 55 PE rainscreen panels for the refurbishment of three northwest London council towers at Granville Road carried out between 2011 and 2012.<\/p>\n<p>But in defence documents lodged with the court, Arconic said that Reynobond 55 PE was \u201cmanufactured exclusively in France\u201d and was sold to Equans\u2019s subcontractor CEP Architectural Facades in France following a contract subject to French law.<\/p>\n<p>Although Arconic is a multinational firm headquartered in the US, it operates in Europe from offices in Merxheim, France.<\/p>\n<p>Because of this, Arconic argued that it cannot be held liable under section 149 of the Building Safety Act 2022 (BSA), which Equans is pursuing as part of its claim against Arconic.<\/p>\n<p>Section 149 of the BSA introduces a legal action pathway for claims against suppliers and manufacturers of defective cladding products.<\/p>\n<p>Arconic\u2019s filing said: \u201cIt is denied that section 149 of the BSA 2022 has extra-territorial effect, so as to make Arconic a person who \u2018manufactures\u2019 or \u2018supplies\u2019 a \u2018cladding product\u2019 within the meaning of section 149\u2026\u201d<\/p>\n<p>The firm said that Equan\u2019s attempt to seek building liability orders against three affiliate firms \u2013 Arconic Manufacturing (GB) Ltd, Arconic France Holding SAS and Arconic UK Holdings Ltd \u2013 were also invalid because the relevant part of the BSA only applies to England and Wales.<\/p>\n<p>Arconic also denied that Reynobond 55 PE panels, which were also used on Grenfell Tower, were \u201cinherently defective\u201d under section 149 of the BSA.<\/p>\n<p>It said: \u201cReynobond 55 PE panels (which Arconic did not manufacture or supply, merely producing the raw material that others fabricated into panels) were not inherently defective and could be used safely as a material for incorporation in an external wall and\/or cladding panel, without presenting a significant danger to those using a building on which it had been installed or to the safety and durability of that building, whether in cassette or riveted form.\u201d<\/p>\n<p>The client on the job, Barnet Council, entered a \u00a35.49m settlement with Equans in 2025 to recover the costs of removing and replacing the cladding of the Granville Road towers.<\/p>\n<p>Separately, the refurbishment\u2019s principal design consultant, Hadley Design Associates, and the engineering firm responsible for the design of the rainscreen\u2011cladding system, Mark Heywood Associates, each agreed to pay Equans \u00a31.38m to settle its claims in relation to the dispute with the council.<\/p>\n<p>Equans is seeking to recover the remaining \u00a32.73m, plus interest, from Arconic.<\/p>\n<p>But in its defence, Arconic claimed that any potential defects would have lain in the system design, not the ACM panels..<\/p>\n<p>\u201cIf [\u2026] the towers were unfit for habitation, this was because Equans and\/or its advisors and\/or agents failed to act with reasonable skill and care in the performance of its contractual design and construction obligations and was or were, therefore, at primary fault,\u201d Arconic alleges.<\/p>\n<p>It also blamed Equans and its subcontractors for fire safety and wind defects during the refurbishment of the Granville Road towers, and attributed responsibility for the design, material selection and compliance on the contractor.<\/p>\n<p>The Grenfell Tower Inquiry identified Reynobond 55 PE as the <a href=\"https:\/\/webarchive.nationalarchives.gov.uk\/ukgwa\/20250319155650\/https:\/assets.grenfelltowerinquiry.org.uk\/GTI%20-%20Phase%201%20report%20Executive%20Summary.pdf\">\u201cprimary cause\u201d<\/a> of the fire\u2019s rapid spread on 14 June 2017, which killed 72 people.<\/p>\n<p>The inquiry\u2019s final report <a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/66d817aa701781e1b341dbd3\/CCS0923434692-004_GTI_Phase_2_Volume_1_BOOKMARKED.pdf\">concluded<\/a> that Arconic \u201cdeliberately concealed from the market the true extent of the danger\u201d of its Reynobond panels and was one of the companies accused of engaging \u201cin deliberate and sustained strategies to manipulate the testing processes, misrepresent these data and mislead the market\u201d.<\/p>\n<p>Equans did not respond to <em>Construction News&#8217;<\/em>\u00a0request for comment.<\/p>\n<p>Arconic declined to
