The parent companies of collapsed Ardmore Construction say a \u00a340m legal claim by Taylor Wimpey is invalid because they reached settlement on the contract two years ago.<\/p>\n

Taylor Wimpey<\/a> is seeking a building liability order (BLO) and damages over fire safety and design defects to 72 properties at Morea Mews, Aberdeen Lane, Islington, which were built in 2015.<\/p>\n

Ardmore Construction Group<\/a>, Ardmore Group and Ardmore Group Holdings say Ardmore Construction Ltd\u2019s (ACL\u2019s), now in administration, liability had already been \u201cdischarged\u201d.<\/p>\n

In defence papers filed at the High Court, the firms claim they reached a full and final settlement of \u00a31.5m with Taylor Wimpey in April 2023 and ACL paid a further \u00a38.17m in March 2023 to cover homeowners\u2019 remediation, relocation and related costs.<\/p>\n

The parent companies claim the settlement with Taylor Wimpey included a clause releasing both the contractor and its parent companies from any future claims linked to the design-and-build contract, the remedial works contract, the Defective Premises Act or any building safety risk.<\/p>\n

It says any claim is a breach of the agreement.<\/p>\n

As a result, they argue Taylor Wimpey cannot pursue a BLO, describing it as \u201cmisconceived\u201d and that any claim could only relate to an alleged breach of the settlement agreement.<\/p>\n

The parent companies say it is not \u201cjust and equitable\u201d to grant a BLO because of their relationship with ACL or due to them having common directors.<\/p>\n

They argue that this provision in the Building Safety Act was for \u2018special purpose vehicles\u2019 that dissolve following project completion to avoid liability and prevent property owners from having their homes remediated, not for an operating group like Ardmore.<\/p>\n

The parent companies further claim that Taylor Wimpey failed to follow the pre-action protocol for construction disputes, which is intended to encourage early resolution before court proceedings are issued.<\/p>\n

Taylor Wimpey started legal proceedings last July.<\/p>\n

It alleges defects, including missing or inadequate fire-stopping around service penetrations, compartment walls failing to achieve the required 60-minute fire resistance, missing or defective cavity barriers, and poorly designed and installed ventilation systems.<\/p>\n

One block comprising 59 flats was also found to allegedly have a non-compliant means of escape, resulting in unsafe evacuation routes in the event of fire.<\/p>\n

While the parent companies admit that ACL was responsible for the design and construction of the external walls of Morea Mews, they say the defects were caused by other companies and subcontractors involved in the development.<\/p>\n

\u201cFurther, Taylor Wimpey [is] not itself a \u2018truly innocent\u2019 party. Taylor Wimpey was (or ought) itself to have been a knowledgeable developer, which owed its own duties and obligations, including a duty under section 1 of the [Defective Premises Act], and engaged consultants,\u201d the defence says.<\/p>\n

According to Taylor Wimpey\u2019s original claim, ACL acknowledged the existence of the defects and agreed in 2023 to carry out the remedial works at its own cost. However, the contractor abandoned the project in March 2025 after telling Taylor Wimpey it was struggling financially.<\/p>\n

ACL filed for administration on 28 August<\/a>\u00a0following mounting financial pressure linked to\u00a0historical building remediation claims<\/a>.<\/p>\n

In its claim, Taylor Wimpey is also seeking \u00a33.5m to replace or repair fixtures and fittings. The housebuilder claims they suffered damage from water, mould and rodent excrement after being stored improperly by ACL<\/p>\n

In their defence, ACL\u2019s parent companies deny that the fixtures and fittings were inadequately protected or stored. They are asking Taylor Wimpey to prove the damage was caused by the alleged improper storage.<\/p>\n

The firms also question Taylor Wimpey\u2019s settlement with the homeowners and say it was not \u201creasonable\u201d to pay them \u00a313,759.19 per month to source their own temporary accommodation.<\/p>\n

In addition, the firms have called on Taylor Wimpey to disclose if it has recovered any sums from other parties.<\/p>\n

Taylor Wimpey declined to comment.<\/p>\n
