{"id":537673,"date":"2026-02-09T12:45:05","date_gmt":"2026-02-09T12:45:05","guid":{"rendered":"https:\/\/www.constructionnews.co.uk\/?p=537673"},"modified":"2026-02-09T12:41:14","modified_gmt":"2026-02-09T12:41:14","slug":"bsr-to-morph-into-shadow-single-construction-regulator","status":"publish","type":"post","link":"https:\/\/www.constructionnews.co.uk\/buildings\/building-safety\/bsr-to-morph-into-shadow-single-construction-regulator-09-02-2026\/","title":{"rendered":"BSR to morph into \u2018shadow\u2019 Single Construction Regulator"},"content":{"rendered":"<p>The Building Safety Regulator is set to operate as the shadow Single Construction Regulator (SCR) before the overarching body begins formal operations, officials said last week.<\/p>\n<p>Before Christmas, the government\u2019s prospectus for the new regulator said the <a href=\"https:\/\/www.constructionnews.co.uk\/buildings\/building-safety\/competence-reset-the-single-construction-regulators-shake-up-of-building-professions-16-01-2026\/\">SCR<\/a> would \u201ctake over [the BSR\u2019s] responsibilities\u201d and be the \u201cfoundation for an integrated regulator\u201d but further details were sparse.<\/p>\n<p>Late last year, the BSR was moved out of the Health and Safety Executive to be a standalone body reporting to the Ministry of Housing, Communities and Local Government (MHCLG).<\/p>\n<p>And in a briefing on the SCR held last week (5 February), Serhan Wade, a policy lead for the SCR at MHCLG, said: \u201cAlthough the decision to create a new body for the Building Safety Regulator was motivated by improving its operational performance, creating a new body ahead of primary legislation is an opportunity to start building the future regulator in shadow form.\u201d<\/p>\n<p>Maddy Badcott, strategy lead for building safety and performance at the department, said: \u201cNow we have moved the new safety regulator out of the Health and Safety Executive, that arm\u2019s length body should&#8230; be the basis for the new single regulator.<\/p>\n<p>\u201cOur intention is for there to be as little disruption as possible. Obviously [&#8230;] that might change as we develop the legislation with lawyers, but hopefully that helps clarify the intention is for that body to become the single regulator.\u201d<\/p>\n<p>Joe Murphy, head of single regulator design at the department, said that setting up the SCR from within the BSR would mean the government was \u201cnot starting from scratch, helping to set it up more efficiently\u201d.<\/p>\n<p>The exact legislative framework for creating the SCR was still under discussion, he said.<\/p>\n<p>He said: \u201cDo we need a whole new, kind of legislative framework that sets up a new body, or can we use parts of the system that we\u2019ve already got, parts of legislation we\u2019ve already got? We need to work through that.\u201d<\/p>\n<p>A number of questions from attendees at the online briefing sought greater clarity on the possibility, raised in the SCR prospectus, that <a href=\"https:\/\/www.constructionnews.co.uk\/buildings\/building-safety\/more-construction-roles-could-face-licensing-and-registration-18-12-2025\/\">more built environment professions could face mandatory licensing<\/a>.<\/p>\n<p>Jon Rowling, senior specialist, building standards at the Royal Institution of Chartered Surveyors, asked: \u201cDoes the scope\u2026 extend to builders, tradespeople, SMEs, who are carrying out work across the country, day in, day out? It would be very difficult to regulate them, but it\u2019s a big area of concern among consumers, the quality of construction work.\u201d<\/p>\n<p>Chris Barrett, senior policy advisor at MHCLG, replied: \u201cWe haven\u2019t defined the scope of the professions reforms yet. We will be asking questions and inviting views as part of the call for evidence that\u2019s coming out in the spring.
