style=\"font-weight: 400;\">Construction News<\/span><\/i><span style=\"font-weight: 400;\"> they are \u201cworking together\u201d to complete the restoration of the city\u2019s town hall by spring 2027 after abandoning a legal fight.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bovis Construction (Europe) Ltd, the main contractor for the<\/span><a href=\"https:\/\/www.constructionnews.co.uk\/buildings\/hive-of-activity-scaffolding-manchester-town-hall-30-03-2023\/\"> <span style=\"font-weight: 400;\">Manchester Town Hall refurbishment project<\/span><\/a><span style=\"font-weight: 400;\">, launched a claim in the High Court against Manchester City Council in November to enforce an adjudicator\u2019s award granting it extra time for the works.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But now the legal action has been paused after both sides found common ground.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a joint statement to <\/span><i><span style=\"font-weight: 400;\">CN<\/span><\/i><span style=\"font-weight: 400;\">, the council and Bovis said: \u201cManchester City Council and Bovis are working together to complete the Our Town Hall project in spring 2027.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cVery positive progress has been made and the council and Bovis are aligned.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cAs such, the court action will be withdrawn as soon as legal formalities have been concluded.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The dispute between Lendlease \u2013 since rebranded as Bovis \u2013 and the council centred on the length of the extension of time the contractor was entitled to for a \u201ccritical delay\u201d to the project between May 2021 and February 2023.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The delay affected both segments of the project: the Town Hall restoration (section\u202fone) and the redevelopment of Albert Square (section\u202ftwo).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The contract administrator granted Bovis an extension of 204 days for each section of the project.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, neither side was happy with the outcome: Bovis considered the extension insufficient, whereas the council thought it was too long.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On 23 June 2025, Manchester City Council served a notice of adjudication and HH Frances Kirkham CBE was appointed as adjudicator.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to court papers filed by Bovis, the council argued during the adjudication that the contract administrator acted within his powers and that the extensions should either remain as originally awarded or be reduced.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But Kirkham concluded that the \u201cfair and reasonable\u201d extensions should be longer, at 338\u202fdays for section\u202fone and 427\u202fdays for section\u202ftwo.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In legal correspondence in the weeks following the adjudication decision, the council said Kirkham\u2019s conclusions were beyond her authority as adjudicator.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It maintained that the adjudicator\u2019s award was \u201cof no effect and unenforceable\u201d, and that the project completion dates should stay as established by the contract administrator.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bovis insisted that the adjudicator\u2019s decision was binding on both sides and that the council had to implement her extension.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On 19 November 2025, Bovis submitted a claim to the High Court to enforce the adjudication.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But after the parties made \u201cvery positive progress\u201d on the dispute, Mr Justice Waksman issued an order staying the proceedings the following month.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The project to restore the grade I-listed neo-gothic Manchester Town Hall and Albert Square has been affected by delays and a<\/span><a href=\"https:\/\/www.constructionnews.co.uk\/buildings\/further-delays-hit-manchester-town-hall-restoration-as-budget-spirals-by-95m-01-12-2025\/\"> <span style=\"font-weight: 400;\">59 per cent budget hike<\/span><\/a><span style=\"font-weight: 400;\"> from the initial \u00a3330m to \u00a3524.8m, as of December 2025.<\/span><\/p>\n<p><a href=\"https:\/\/www.constructionnews.co.uk\/contractors\/lendlease\/\"><span style=\"font-weight: 400;\">Lendlease<\/span><\/a><span style=\"font-weight: 400;\"> was initially appointed as main contractor in 2019. Since then, the Australian group sold its UK construction business to US private equity firm Atlas Holdings, which <\/span><a href=\"https:\/\/www.constructionnews.co.uk\/financial\/bovis-returns-as-uk-construction-brand-after-lendlease-sale-completes-31-03-2025\/\"><span style=\"font-weight: 400;\">resurrected the Bovis brand name<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The council said the project had been hit by a \u201cunique combination\u201d of challenges, including a shortage of specialist labour, \u201cunprecedented materials and labour cost inflation\u201d, and subcontractor collapses.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cSuch is the complexity of the project that any delay to one element of work has a knock-on impact on many others,\u201d the council said in December.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The project was originally due to finish in summer 2024.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Manchester City Council and Bovis have told Construction News they are \u201cworking together\u201d to complete the restoration of the city\u2019s town hall by spring 2027 after abandoning a legal fight.
