two separate cases<\/a> were brought following investigations by the Office for Nuclear Regulation (ONR).<\/p>\nOne of the cases relates to the death of worker Jason Waring, 48, who died on 13 November 2022 after sustaining fatal injuries at the nuclear power station construction site in Somerset.<\/p>\n
Yesterday (17 February), a trial date was set for 17 January 2028 at Bristol Crown Court, with hearings expected to last between four and six weeks, the ONR said.<\/p>\n
In December, Laing O\u2019Rourke Delivery Ltd and Bouygues Travaux Publics SAS each entered not guilty pleas to a charge of failing to plan, manage and monitor that construction work was carried out without risks to health and safety, contravening Regulation 15(2) of the Construction (Design and Management) Regulations 2015, according to the ONR.<\/p>\n
The two firms make up the Bylor joint venture, which is delivering the main civil engineering works at Hinkley Point C.<\/p>\n
In December a third firm, NNB Generation Company (HPC) Ltd (NNB GenCo), the principal contractor on the project and a subsidiary of EDF Energy, denied charges of failing to plan, manage and monitor the construction phase, the ONR said.<\/p>\n
NNB GenCo also denied coordinating matters relating to health and safety during the construction phase to ensure that work was carried out without risks to health and safety, contravening Regulation 13(1) of the Construction (Design and Management) Regulations 2015, the ONR said.<\/p>\n
The second case relates to an incident at Hinkley Point C on 20 August 2022, when employee Paul Dunne, who worked for Bylor as a slinger, sustained serious injuries in a pre-fabrication yard when a wall of rebar mesh fell on him, the ONR said.<\/p>\n
He was working to remove the wall from a vertical jig to be transferred to another part of the site, the regulator added.<\/p>\n
According to the ONR, a trial date has been set for 13 October 2027 at Bristol Crown Court.<\/p>\n
In this case, Laing O\u2019Rourke and Bouygues Travaux Publics also deny a separate charge of failing to plan, manage and monitor to ensure that construction work was carried out without risks to health and safety, contravening Regulation 15(2) of the Construction (Design and Management) Regulations 2015.<\/p>\n
The ONR said two further charges of failing to conduct a suitable and sufficient risk assessment of the risks to the health and safety of their employees, under Regulation 3 (1) (a) of the Management of Health and Safety At Work Regulations 1999, contravening Section 33(1)(c) of the Act, were put to Laing O\u2019Rourke and Bouygues Travaux Publics on Tuesday.<\/p>\n
Both firms entered not guilty pleas, the ONR said.<\/p>\n
A spokesperson for Hinkley Point C said: \u201cSafety is our overriding priority and the project cooperated fully with the ONR investigation. Our thoughts primarily remain with the family, friends and colleagues of Jason. As legal proceedings are ongoing, it would not be appropriate to comment further at this time.\u201d<\/p>\n
